First degree retail fraud is a felony punishable by up to five years in prison and/or may receive a fine of up to $10,000.00 or no more than 3 times the value of what they stole. Second degree retail fraud is a misdemeanor punishable by no more than a year in jail and/or may receive a fine of up to $2,000.00 or no more than 3 times the value of what they stole. Finally, third degree retail fraud is a misdemeanor punishable by up to 93 days in jail and/or may receive a fine of up to $300.00 or no more than 3 times the value of what they stole.
