Kalkaska MI Car Accident – Two Livonia Residents Killed In Car Crash, One Injured

Kalkaska Michigan Car Crash – Two Livonia Residents Killed And One Injured

I just read about a sad story from out of Kalkaska, Michigan. A high school golf coach, driving his team to a golf tournament, ran a stop sign and collided with another van driven by a woman, Rhonda Mitchell, who was driving 77 mph in a 55 mph zone and under the influence of marijuana and morphine. Three people were killed in the accident – Mitchell’s daughter, the golf coach and one of his players. Mitchell has since been charged with three counts of manslaughter.

Who’s Responsible?

Regarding a potential lawsuit for the families of those killed, and the other injured parties, in this horrific accident, it is clear that both drivers were negligent. The golf coach ran a stop sign, and Mitchell was driving while intoxicated at a speed that was 22 mph over the limit. Mitchell’s criminal liability appears fairly clear. But what about her civil liability? Under Michigan’s No-Fault law, those who sustain a threshold injury may sue the negligent party for non-economic damages like pain and suffering and other consortium type of losses. In this case, it appears that most parties will have their pick between Mitchell, the golf coach’s estate and the school district. It is likely that most will go after the school district as it is the one that is most likely to have the ability to pay off any judgment rendered against it.

Summary

A horrifying accident in Kalkaska shows that multiple drivers may be negligent in a car accident. And in these cases where multiple people are killed or injured, a plaintiff is going to have her pick when it comes time to hold those who are negligent responsible for their actions. Pedestrian Injured in Detroit when Tire Flies Off Car

Pedestrian Injured in Detroit When Tire Flies Off Car

I came across an awful story this morning from Detroit. A bystander on a sidewalk was critically injured when two cars collided with one another at the corner of Seven Mile and Fairport Road. Apparently a tire flew off from one of the cars and struck the pedestrian before shattering through a store window. Pedestrian Injured in Detroit When Tire Flies Off Car – what are the legal ramifications? Do you need a Michigan pedestrian accident lawyer?

Is There a Legitimate Lawsuit?

I’m sure the last thing that is on anybody’s mind who is directly involved with this situation is whether a lawsuit exists. However, there is little doubt that someone will have to foot the bill for the pedestrian’s medical bills which are likely to be substantial. Even though the pedestrian wasn’t in one of the cars when they collided, because the injuries are the result of a motor vehicle accident, the pedestrian is entitled to personal injury protection benefits (PIP) under Michigan’s No-Fault Act whether he/she was insured or not. These benefits cover all economic damages like medical bills, rehabilitation, attendant care, lost wages, etc. It is also important to note that because the pedestrian was critically injured, it is likely that he has a legitimate third party claim against the negligent party who caused the injuries. Third party claims are filed to collect non-economic damages like pain and suffering.

Negligence refers to the unintentional wrongful conduct of another, and it comes in many different forms. Someone can cause someone harm by allowing a dangerous condition to exist on his property which may put others in harm’s way. At Goldman & Associates we realize that boating accidents are also particularly dangerous and can cause a lifetime of pain and suffering. Negligence holds individuals accountable for damages they have created. Perhaps the owner of a boat does not have all of the life jackets on board for every passenger? Or maybe the captain has disregarded the no-wake signs and lost control of his vessel. What about the boaters who are operating their craft under the influence of alcohol? There is a wide range of activities that could constitute negligence on the water. Only an experienced Michigan personal injury lawyer can let you know whether you have a legitimate cause of action.

Michigan Boating Accident in Sylvan Lake

Boat Accident in Sylvan Lake Michigan – Boating  accident involving children

You can almost imagine it if you close your eyes. One of Michigan’s most beautiful summer days by the lake. You can remember all types of wonderful images; the sunny sky, the gentle breeze and the waves slowly lapping up on the shore. If you live in Michigan chances are you have experienced that glorious sight. A scene that is so peaceful and quiet. One could assume that it is almost like heaven. We are truly blessed to live in such a wonderful State with all of the lakes that surround our shores. Michigan truly is a water wonderland! However, we must remain ever vigilant. With all that water comes some real dangers. We must always remember that some very horrific dangers are ever present in the water. Unfortunately, last week we were tragically reminded of those ever present dangers.

A father, John Mansour, and his three children, Alexander age 11, Adriana age 10 and Gabrielle age 6 were just having a fun day out on Sylvan Lake located in West Bloomfield Township. The father was pulling them on an inner tube with 10 feet of tow line behind his two seat personal watercraft. The initial report is that the Jet Ski was Southbound on the lake, when the boat traveling Eastbound drove over the tow line and tube carrying the three children. The Oakland County Sheriff’s Office said the children were taken to McLaren Hospital in Pontiac, where the boy was pronounced dead. The two girls were transferred to Beaumont Hospital in Royal Oak. Gabrielle Mansour, 6, died at Beaumont Hospital in Royal Oak the day after the tubing accident that killed her 11-year-old brother, Alexander. Adriana remains at the hospital in critical condition.

It is with extreme sorrow that we need to discuss such matters.

Our thoughts and prayers go out to everyone who has been devastated by this disaster. Who is to blame for such a horrific accident? Does it really matter? Some may argue that it does not matter who is to blame. The final outcome cannot be changed. The families and the communities will be forever changed due to that one moment in time that cannot be replayed. The problem is that this scene will be replayed. Over and over again; go to one of our lakes this summer and sit down and take a look. You will probably see a Jet Ski or two and probably see some kids being towed behind one on an inner tube. The best way to honor the children who have lost their lives is to make sure that this does not happen again! Make sure that one more precious child is not lost due to the negligence of others.

Our experienced attorneys have worked on many tragic accident cases.

When accidents involve young children they seem to be particularly devastating. No, it will not change the outcome but maybe by learning who was negligent we can prevent this from happening again! There were many things that “went wrong” that day. There was no spotter protecting those children. This is a violation of Michigan boating law. Michigan law prohibits two person personal water craft to pull a tuber. What about the boat that hit the kids? Was it speeding? Was he operating his vessel too close to the personal water craft? What about the Oakland County Sheriff’s Office? They stopped patrolling Sylvan Lake several years ago! When we get the answers to these questions we will be in a better position to protect our children.

In addition to offering Michigan Boater safety classes in our public schools Michigan now offers two online boating safety classes and an exam. The website’s are as follows: BoatEd.com and BoaterExam.com.

Make sure to practice boater safety:

• Wear life jackets at all times
• Operate vessels and crafts at least 100 feet away from shore, docks or other vessels
• Maintain a reasonable speed
• At all times remain fully alert of your surroundings and other boaters
• Refrain from consuming alcohol while operating any vessel on the water
• Keep a close watch on young children, with an adult monitoring their activity at all times
• Learn and follow the boating safety laws and regulations in your community
• Have a working knowledge and understanding of how your vessel or PWC operates and performs on the water and conduct regular maintenance checks to prevent mechanical failure
• If you are going to tow anything, have a spotter on what you are towing and if what you are towing is smaller that you make sure it is clearly visible to all others on the water with you by using flags during the day. At night add lights and reflectors not only on what you are towing but on the tow line as well and if possible add another boat behind the tow also.

Remember, it only takes a minute to practice boater safety and it could affect your future in a very dramatic way. Practice boater safety and continue to enjoy the water wonderland that is Michigan.

Driving With a Suspended or Revoked License

Driving With a Suspended or Revoked License in Michigan

Why Would My License be Suspended?

There are a lot of reasons why one’s driver’s license would be suspended or revoked. Surprisingly enough, we get calls from lots of people who never found out that their license was suspended until they were pulled over by a police officer and charged with driving with a suspended license. It could be in some cases that a driver’s license is suspended because the individual has committed a traffic or criminal offense that automatically calls for a suspension. In other cases it could be that the driver has accrued too many points or failed to pay past citations. Finally, in many other cases, it could be that the driver has been held in contempt by a judge, and a judge has decided to sanction the individual by suspending a driver’s license. Regardless of the reason for which a license is suspended, if you have been cited or arrested for driving with a suspended license, you need to contact an attorney.

It’s a Criminal Offense

Driving with a suspended license is not just a traffic ticket in Michigan. It is a misdemeanor criminal offense that will stay on your criminal record. A first offense is punishable by up to 93 days in jail and/or a fine of up to $500.00. Any subsequent offense is punishable by up to a year in jail and /or a fine of $1000.00. Depending on whether any other aggravating factors exist, a charge or its penalties could be enhanced to the detriment of the offender. If you have been charged with this offense, you need an attorney to help you stay out of jail, pay off your fines and costs, keep you on the road and attempt to keep your criminal record clean. One last important note to make related to one’s criminal record is that a conviction for driving with a suspended license is not an offense that can be expunged from one’s criminal record. Therefore, this conviction will stay on your record forever.

Dividing Debts in a Michigan Divorce

Michigan Divorce – Dividing Debts

Most people understand that most divorces end with an equitable (close to even) split of marital property. It follows then that each side should be assessed an equal portion of marital debt also. However, just as an argument can be made that one’s separate property should be construed as marital property, an argument may also be made that debt accrued during marriage should be assessed to the party who created the obligation. Often times, there is wiggle room to make these kinds of arguments, but you really need an experienced divorce attorney to help you make articulate a winning position.

What is Marital Debt?

Generally, marital debt is any debt or obligation that is created after the parties have been lawfully married. Debts owed by the parties before the marriage are considered to be their own separate obligations, therefore, these debts are unlikely to be an issue in divorce cases.

When Could I be Assessed More Marital Debt than my Ex?

There are certain instances where a debt or obligation created during the marriage may be assessed solely to one party over another, or where one party assumes more overall marital debt compared to the other party. A number of factors are considered when equitably dividing marital assets and debts, and one such factor is that of fault. If one party has created marital debts because of a gambling or drug problem, to pay for a paramour or to defend oneself in a criminal prosecution; it is likely that these debts could be assessed solely to that party. In other situations it may make sense to leave one party with additional debt because he/she is in a better position to sustain him or herself after the marriage.

Contact an Experienced Divorce Attorney Today

In many ways, marital debt may be used as a bargaining chip to provide leverage in making a deal for one party over the other. If you are getting divorced, you need to contact an experienced divorce attorney to help you sort out these issues. Akiva Goldman & Associates specialize in property division and divorce, and we have served Metro Detroit for over twenty-five years. Contact us today for a free consultation at 586-268-2400.
